Events Release and Waiver of Liability 2026
Please read all provisions of this Release and Waiver of Liability for Participation in APAC SME’s EXPO 2026 (the “Agreement”) carefully before agreeing.
1. Acknowledgment and Acceptance of Risk and COVID-19 Waiver.
I acknowledge that there are certain inherent risks that participants voluntarily assume when attending the APAC SMEs EXPO 2026 (the “Event”). I understand and agree that neither BNI (“BNI”), its present and former officers, employees, members, directors, agents, servants, representatives, parents, affiliates, subsidiaries, franchisees, partners, sponsors, successors, and assigns (the “BNI Releasees”), nor any cooperating institution, assumes any responsibility for damages to or loss of my property, personal illness, injury, or death to me while I participate in the Event, including, but not limited to, activities during the Event and any travel to or from my place of residence, to and from the airport, and to and from the venue. I freely assume any risk associated with or arising out of traveling.
I am aware that COVID-19 (including its variants) continues to be extremely contagious. I understand that attending the Event may increase the risk of directly or indirectly contracting COVID-19 and voluntarily assume the risk and any resulting personal injury, illness, permanent disability, and even death (“Injury”). I acknowledge and freely assume any and all risks arising out of or related to being exposed to, contracting, or spreading COVID-19. I do hereby forever release and waive my right to bring suit against the BNI Releasees in connection with exposure, infection and/or spread of COVID-19 related to my participation in the Event to the fullest extent permitted by applicable law. I understand that this means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
2. Release and Discharge.
I hereby release, waive and forever discharge any and all liability, claims, and demands of whatever kind or nature against BNI Releasees, either in law or in equity, to the fullest extent permissible by law, including but not limited to damages or losses caused by the negligence, fault or conduct of any kind on the part of BNI Releasees, including but not limited to death, bodily injury, illness, economic loss or out of pocket expenses, or loss or damage to property, which I, my heirs, assignees, next of kin and/or legally appointed or designated representatives, may have or which may hereinafter accrue on my behalf, which arise or may hereafter arise from my participation in the Event.
3. Indemnification and Hold Harmless.
I agree to irrevocably and forever indemnify, defend, and hold harmless BNI Releasees from and against any and all third-party claims, actions, suits, procedures, costs, expenses, damages, liabilities, and expenses of whatever kind, including attorney fees, brought as a result of my participation in the Event. I further agree to indemnify and hold them harmless BNI Releasees with regard to any financial obligations, liabilities, monetary loss or expenses that I may personally incur or any damage or injury to the person or property of others that I may cause, as a result of my participation in the Event.
4. Photo & Video Release.
I agree to irrevocably authorize BNI and its subsidiaries, agents, assignees and licensees (collectively in this paragraph, “BNI”) to use images of me captured by BNI whether in photos, film, video or otherwise (collectively the “Photography”) in its marketing and promotional materials for its websites, print assets, and BNI Brand Share among others. I further authorize BNI to attribute the Photography to me and, for that purpose, I authorize BNI to use my name (and city and state of residence), likeness, signature, image and voice, as appropriate, in connection with the Photography. I understand that BNI may edit my photograph due to space considerations or for any other reason, and I consent to the editing or alteration of my photograph. I hereby release BNI from any and all claims that I may have whatsoever in connection with the Photography, including without limitation claims at law or in equity, known or unknown, suspected or unsuspected, arising out of or related to the use of my likeness, name, and/or voice. I hereby waive any right that I may have to inspect and/or approve the use of the Photography, or any collateral materials that may be produced by BNI in connection with the Photography. I hereby acknowledge that all right, title and ownership in and to the Photography, including any and all copyrights and moral rights, shall be the exclusive property of BNI and, to the extent I have any, I hereby assign all right, title and interest in the Photography to BNI.
5. Activity Waiver.
I acknowledge that BNI may organize various optional activities before, during and after the Event, including but not limited to outdoor adventures, hiking, camping, wilderness excursions, cruises, and water activities. I acknowledge that the Activity may cause physical injury and I agree to assume full responsibility for any risks, injuries or damage known or unknown which I might incur as a result of participating in the Activity. I hereby release, waive, covenant not to sue, and discharge any and all claims, including third-party claims for damages, injuries, or losses, and liability for any injuries or damage against the BNI Releasees. I agree to indemnify and hold harmless the BNI Releasees from any liabilities arising from my participation in the Activity.
